Terms of Service

These terms are an agreement between you and Myndgard Limited ("Myndgard", "we", "us"), a company registered in Ireland, for your use of the Myndgard app, web portal and related services (the "service"). Please read them together with our Privacy Policy.

1. Who can use Myndgard

Myndgard is provided to you through your university, college or therapy practice ("your care provider"). You can use it only if your care provider has invited you and you are 18 or over. Keep your password private. You are responsible for activity on your account and should tell us promptly at support@myndgard.com if you think someone else has used it.

2. What Myndgard is and is not

Myndgard supports the care your care provider gives you. It helps you complete questionnaires, record mood and activity, and stay in touch with your clinician.

Myndgard is not an emergency service. Messages and questionnaire answers are not monitored around the clock. If you are in danger or need urgent help, call 112 or 999, or Samaritans on 116 123.

Myndgard does not diagnose or treat any condition. Questionnaire scores are screening measures. They are not a diagnosis and do not replace advice from a qualified professional. Decisions about your care are made by your clinicians.

3. Using the service properly

You agree not to misuse the service. That includes:

• accessing another person's account or information
• interfering with the service's security or operation
• uploading anything unlawful, abusive or harmful
• using the service for any purpose other than your own care

We may suspend accounts that break these rules or that put others at risk, and we will tell your care provider where appropriate.

4. Your information

You own the information you enter. You give us permission to store and process it only to provide the service, as described in the Privacy Policy. You can export it or delete your account at any time.

5. Availability and changes

We work to keep Myndgard available and secure, but we cannot promise it will always be uninterrupted or error-free. We may change or improve the service. If we make a material change to these terms, we will tell you in the app and portal and ask you to accept the new version before you continue.

6. Ending your use

You can stop using Myndgard and delete your account at any time from Profile → Delete account in the app or Account settings → Privacy in the portal. Your access may also end if your care provider stops offering Myndgard. In that case we will give you a chance to export your information first.

7. Liability

Nothing in these terms limits any rights you have as a consumer under Irish or EU law, or our liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not responsible for losses that were not reasonably foreseeable, or for decisions made by your care provider or clinicians.

8. Law

These terms are governed by the law of Ireland. If you live elsewhere in the EU, you also keep the protection of the mandatory consumer laws where you live.
